1. Purpose, Scope and Responsible Gaming Principles

Winberry.casino is committed to providing an enjoyable entertainment experience while promoting responsible gaming and taking reasonable steps to reduce the risk of problematic or harmful gaming activity.

This Responsible Gaming Policy explains the responsible gaming tools, information, restrictions, support options, and internal measures that may be available or applied in connection with a player’s use of the Platform.

The Company may take responsible gaming action where it considers such action appropriate for player protection, account safety, fraud prevention, AML/KYC, legal, regulatory, payment, operational, or compliance reasons.

This Policy should be read together with the Company’s Terms and Conditions, Privacy Policy, AML/KYC policies, bonus and promotional rules, and any other applicable rules published by the Company from time to time.

2. Player Awareness, Self-Evaluation and Educational Resources

The Company encourages players to regularly assess whether their gaming activity remains controlled, balanced, and consistent with entertainment purposes.

Players should consider taking a break, setting limits, requesting a Time-Out or self-exclusion, or contacting Customer Support if they answer “yes” to one or more of the following questions:

  • Do you find it difficult to stop, pause, or reduce your gaming activity?
  • Do you spend more time or money on the Platform than you originally intended?
  • Do you return to recover previous losses or change previous outcomes?
  • Has gaming affected your work, studies, family, health, relationships, or daily responsibilities?

  • Do you feel stressed, anxious, frustrated, or upset because of your gaming activity?
  • Do you hide or misrepresent your gaming activity from family, friends, or others?

Active reminders are informational only and do not replace the player’s responsibility to monitor their own activity, use available responsible gaming tools, and seek support where needed.

4. Self-Limitation Tools

Players may request responsible gaming limits, self-limitation tools, or account restrictions to help manage their activity on the Platform.

Self-limitation tools are intended to support players in maintaining control over their spending, gameplay, session duration, and account access.

Such tools and restrictions may be requested by contacting Customer Support or by using available account functionality, where such functionality is supported.

The availability, format, timing, and technical implementation of any self-limitation tool, limit, restriction, setting, or account feature may depend on the Platform’s functionality, account status, jurisdictional requirements, payment functionality, and internal responsible gaming procedures.

The Company does not guarantee that any specific type of limit, restriction, setting, or account tool will be available at all times, in all jurisdictions, or through the player account interface.

Where a requested responsible gaming measure is not technically available in the exact form requested by the player, the Company may offer or apply an alternative responsible gaming measure, including a Time-Out, self-exclusion, account access restriction, purchase restriction, gameplay restriction, or account closure.

A request to make a limit or restriction stricter may be applied promptly or as soon as reasonably practicable.

A request to remove, increase, relax, or reduce the effect of a limit or restriction may be subject to a waiting period, additional confirmation, responsible gaming review, account review, or other checks determined by the Company.

The Company may refuse to remove, increase, or relax a limit or restriction where it considers that doing so may create responsible gaming, account safety, fraud prevention, AML/KYC, legal, regulatory, payment, operational, or compliance risks.

The Company may also apply limits or restrictions to an account on its own initiative, even if the player has not requested such limits or restrictions, where the Company considers this appropriate for responsible gaming, account safety, fraud prevention, AML/KYC, legal, regulatory, payment, operational, or compliance reasons.

Self-limitation tools are intended to support responsible gaming, but they do not replace the player’s personal responsibility to monitor their activity, make informed decisions, and seek support where needed.

5. Time-Out / Cooling-Off

A Time-Out, also referred to as a Cooling-Off period, is a short temporary break from gaming activity. It is intended for players who wish to pause their activity for a limited period of time without applying a longer self-exclusion.

The Company may offer Time-Out periods such as:

  • 24 hours;
  • 72 hours;
  • other period made available by the Company from time to time.

A Time-Out is not the same as self-exclusion and should not be treated as a substitute for self-exclusion where a player believes they are unable to control their gaming activity.

During an active Time-Out, the Company may restrict one or more of the following account functions:

  • gameplay activity;
  • purchases or deposits;
  • promotional participation;
  • bonus activity;
  • access to certain account features;
  • account login or account access, where technically supported.

The exact restrictions applied during a Time-Out may depend on the Platform’s technical functionality, account status, product configuration, jurisdictional requirements, and internal responsible gaming procedures.

Once a Time-Out has been applied, it cannot be shortened, cancelled, reversed, or removed before the selected period expires.

At the end of the Time-Out period, account access or restricted functionality may be restored automatically or following Company review, depending on the account status and the reason for the restriction.

The Company may refuse to restore access or may apply additional restrictions where it identifies responsible gaming, account safety, fraud prevention, AML/KYC, legal, regulatory, payment, operational, or compliance concerns.

During a Time-Out, withdrawals and remaining balances will be handled in accordance with the Terms and Conditions and may remain subject to KYC, AML, fraud prevention, payment provider checks, chargeback review, account review, and other applicable controls.

A Time-Out does not cancel, waive, or override any pending verification, payment review, fraud review, chargeback review, bonus rule, redemption requirement, or other obligation under the Terms and Conditions.

During a Time-Out, the Company may pause promotional, bonus, VIP, or retention communications where reasonably practicable.

6. Self-Exclusion, Consent and No Early Reinstatement

Self-exclusion is a responsible gaming measure intended for players who wish to restrict their access to the Platform for a selected period of time.

Self-exclusion is intended for situations where a player believes they need a formal restriction on their account activity.

The Company may offer self-exclusion periods such as:

  • 7 days;
  • 14 days;
  • 30 days;

Players who wish to stop using the Platform indefinitely may contact Customer Support to request account closure.

Account closure requests may be subject to verification, account review, pending transaction review, fraud prevention checks, AML/KYC checks, payment provider requirements, chargeback review, and other controls under the Terms and Conditions.

During an active self-exclusion, the Company may restrict one or more of the following:

  • gameplay activity;
  • purchases or deposits;
  • bonus activity;
  • promotional participation;
  • VIP or retention activity;
  • access to certain account features;
  • account login or account access, where technically supported.

The exact restrictions applied during self-exclusion may depend on the Platform’s technical functionality, account status, product configuration, jurisdictional requirements, and internal responsible gaming procedures.

Before applying self-exclusion, the Company may require the player to confirm that they understand and accept the consequences of self-exclusion.

Such confirmation may include acknowledgement that:

  • the player’s account access and gameplay activity may be restricted;
  • purchases or deposits may be restricted;
  • bonuses, promotions, VIP benefits, and retention offers may be restricted;
  • the selected self-exclusion period cannot be shortened, cancelled, reversed, or removed early;
  • the account will not automatically reopen when the self-exclusion period expires;
  • reopening may require a player request, Company review, additional verification, responsible gaming review, or other checks;
  • withdrawals and remaining balances remain subject to the Terms and Conditions, KYC/AML checks, fraud prevention checks, payment provider requirements, chargeback review, account review, and applicable law;
  • attempts to bypass self-exclusion may result in additional restrictions, suspension, or account closure.

Once self-exclusion has been applied, it cannot be shortened, cancelled, reversed, or lifted before the selected period expires.

The Company will not reinstate, reopen, or reactivate a self-excluded account early at the player’s request.

The expiry of a self-exclusion period does not create an automatic right to account reopening. Any reopening may be subject to Company review, additional verification, responsible gaming assessment, account safety review, payment review, fraud prevention review, AML/KYC review, or other checks.

The Company may refuse to reopen an account, or may apply additional limits or restrictions, where it considers that continued access may create responsible gaming, account safety, fraud prevention, AML/KYC, legal, regulatory, payment, operational, or compliance risks.

During an active self-exclusion, withdrawals and remaining balances will be handled in accordance with the Terms and Conditions and may remain subject to KYC, AML, fraud prevention, payment provider checks, chargeback review, account review, and other applicable controls.

Self-exclusion does not cancel, waive, or override any pending verification, payment review, fraud review, chargeback review, bonus rule, redemption requirement, or other obligation under the Terms and Conditions.

The Company will take reasonable steps to prevent promotional, bonus, VIP, or retention communications from being directed to players during an active self-exclusion.

7. Attempted Circumvention and Linked Accounts

Players must not attempt to bypass, avoid, or circumvent any responsible gaming measure, Time-Out, self-exclusion, account restriction, account suspension, account closure, or Company-imposed limitation.

Prohibited circumvention may include, without limitation:

  • creating or attempting to create a new account;
  • using a duplicate, linked, associated, or previously closed account;
  • using another person’s account, identity, payment method, device, or contact details;
  • allowing another person to access the Platform on behalf of the restricted player;
  • providing false, incomplete, misleading, or inconsistent information;
  • changing or attempting to disguise personal details, contact information, payment details, location, device information, or identity information;
  • using a VPN, proxy, remote access tool, emulator, masking technology, or similar method to hide or alter location, identity, device data, or access information;
  • attempting to access the Platform through a different email address, phone number, device, IP address, payment method, identity document, or residential address.

The Company may review accounts for potential links, duplication, association, or circumvention based on information available to it, including account details, identity information, payment information, device data, technical data, location data, transaction activity, gameplay activity, support communications, and other relevant indicators.

Where the Company identifies or reasonably suspects attempted circumvention, it may take one or more of the following actions:

  • restrict, suspend, or close the account;
  • apply or extend responsible gaming restrictions;
  • refuse account reopening;
  • restrict gameplay, purchases, deposits, bonuses, promotions, VIP benefits, or redemptions;
  • cancel, withhold, or revoke bonuses, promotional benefits, or rewards where permitted by the Terms and Conditions;
  • require additional KYC, AML, fraud prevention, payment, source of funds, or account safety checks;
  • combine or review activity across linked or associated accounts;
  • take any other action permitted under the Terms and Conditions, applicable rules, or applicable law.

A player who is subject to a Time-Out, self-exclusion, account closure, or other responsible gaming restriction remains responsible for complying with that restriction and must not attempt to access the Platform through any alternative means.

Any attempt to bypass responsible gaming measures may be treated as a serious breach of this Policy and the Terms and Conditions.

8. Company Intervention, Third-Party Concerns and Company-Imposed Responsible Gaming Restrictions

The Company may take responsible gaming action where it identifies indicators of potential harm, loss of control, excessive activity, unusual account activity, signs of distress, customer complaints, third-party concerns, or other responsible gaming concerns.

The Company may take reasonable steps to protect players and maintain a safe entertainment environment, even where the player has not expressly requested a limit, Time-Out, self-exclusion, or account closure.

Responsible gaming action may include, without limitation:

  • contacting the player;
  • providing responsible gaming information;
  • recommending a break from gaming activity;
  • applying or recommending limits;
  • applying a Time-Out / Cooling-Off period;
  • applying self-exclusion or other responsible gaming restrictions;
  • restricting gameplay activity;
  • restricting purchases or deposits;
  • restricting bonuses, promotions, VIP benefits, or retention activity;
  • temporarily limiting account access;
  • closing the account where appropriate;
  • requesting additional information, verification, or confirmation from the player.

The Company may take such action where it considers this appropriate for responsible gaming, player protection, account safety, fraud prevention, AML/KYC, legal, regulatory, payment, operational, or compliance reasons.

The Company may also receive responsible gaming concerns, exclusion requests, or other reports from family members, friends, representatives, payment account holders, financial institutions, or other third parties.

A third-party report does not automatically result in account closure, self-exclusion, or disclosure of account information. The Company will review such communications on a case-by-case basis.

For privacy, security, and legal reasons, the Company may be unable to confirm whether a person has an account, disclose account details, or provide information about any action taken in response to a third-party report.

However, the Company may use information received from a third party to conduct an internal review and may take reasonable responsible gaming action where it considers this appropriate.

The Company may impose temporary or permanent responsible gaming restrictions on an account on its own initiative. Such restrictions may include account limits, a Time-Out / Cooling-Off period, self-exclusion, account suspension, account closure, or other restrictions intended to protect the player or maintain account safety.

Company-imposed responsible gaming restrictions may apply even where the player has not requested such measures.

Where the Company applies a responsible gaming restriction, the player may be restricted from gameplay, purchases or deposits, bonuses, promotions, VIP benefits, retention offers, or certain account features, depending on the nature of the restriction and the reason for the review.

Withdrawals and remaining balances during any Company-imposed responsible gaming restriction will be handled in accordance with the Terms and Conditions and may remain subject to KYC, AML, fraud prevention, payment provider checks, chargeback review, account review, and other applicable controls.

The Company may refuse to reopen, reactivate, or remove restrictions from an account where it considers that continued access may create responsible gaming, account safety, fraud prevention, AML/KYC, legal, regulatory, payment, operational, or compliance risks.

9. Support Resources, Protection of Minors and Staff Training

Players who believe that their gaming activity may be becoming difficult to control are encouraged to seek support as early as possible.

The Company may provide responsible gaming information and may refer players to independent support organizations that assist individuals who experience gambling-related harm or problematic gaming behavior.

Examples of external support resources may include:

  • Gamblers Anonymous;
  • Gambling Therapy;
  • GamCare;
  • other responsible gaming or problem gambling support organizations available in the player’s country or region.

The Company does not control third-party support organizations and is not responsible for their services, advice, availability, eligibility requirements, or content.

Players are also encouraged to consider blocking or filtering tools, financial controls, device-level restrictions, or other practical measures that may help them manage access to gaming services.

Protection of Minors

The Platform is not intended for use by minors.

Players must be of legal age in their jurisdiction and, in any event, at least 18 years old or such higher age as may be required by applicable law.

The Company does not knowingly permit minors to create accounts, access the Platform, or participate in gaming activity.

The Company may request age, identity, address, payment, or other verification information and may restrict, suspend, or close an account if age, identity, eligibility, or account information cannot be verified.

Parents and guardians are encouraged to take reasonable steps to prevent minors from accessing gaming services, including:

  • password-protecting computers, mobile phones, tablets, and other devices;
  • not leaving devices unattended while logged into an account;
  • keeping account details, passwords, payment methods, identity documents, and cards inaccessible to minors;
  • not saving passwords on shared devices;
  • using parental control, blocking, or filtering software where appropriate;
  • monitoring access to devices and online entertainment services.

If the Company identifies or reasonably believes that an account has been created or used by a minor, the Company may take action in accordance with the Terms and Conditions, applicable law, and internal compliance procedures.

Staff Training

The Company may provide responsible gaming training to relevant staff, including Customer Support, VIP, compliance, fraud, payments, and other operational teams.

Training may cover, as applicable:

  • responsible gaming principles;
  • potential indicators of harmful or uncontrolled gaming activity;
  • handling requests for limits, Time-Outs, self-exclusion, or account closure;
  • escalation of responsible gaming concerns;
  • appropriate handling of vulnerable or distressed players;
  • restrictions on inappropriate retention activity;
  • recordkeeping requirements;
  • privacy and confidentiality considerations;
  • coordination with compliance, fraud, payments, and account safety teams.

The Company may update responsible gaming training materials and internal procedures from time to time based on product changes, operational experience, customer support feedback, complaints, legal or regulatory developments, and internal policy reviews.

10. Recordkeeping and Annual Policy Review

The Company may keep records of responsible gaming matters, including player requests, account restrictions, limits, Time-Outs, self-exclusions, account closures, support communications, player confirmations, internal reviews, and actions taken by the Company.

Such records may be used for:

  • responsible gaming purposes;
  • customer support;
  • account safety;
  • dispute handling;
  • fraud prevention;
  • AML/KYC checks;
  • payment and chargeback review;
  • legal and regulatory compliance;
  • internal audit and operational review;
  • training and policy improvement.

The Company may also keep records of player confirmations related to responsible gaming measures, including confirmations that the player understands the consequences of Time-Outs, self-exclusion, account restrictions, and account closure.

Responsible gaming records may be retained in accordance with the Company’s internal policies, Privacy Policy, Terms and Conditions, legal obligations, regulatory requirements, and applicable data protection rules.

The Company may limit, redact, or withhold records where necessary or appropriate for privacy, security, fraud prevention, AML/KYC, legal, regulatory, payment, operational, or compliance reasons.

The Company will review this Responsible Gaming Policy at least annually and may update it from time to time.

The review may take into account:

  • legal and regulatory developments;
  • changes to the Platform or product functionality;
  • responsible gaming cases and trends;
  • player complaints and support interactions;
  • technical capabilities;
  • fraud, payment, AML/KYC, and account safety considerations;
  • staff feedback and training needs;
  • internal compliance reviews.

The Company may update this Policy without prior notice unless notice is required by applicable law, the Terms and Conditions, or another applicable Company policy.

The latest version of this Policy will apply from the date it is published or otherwise made available by the Company.
